Coates v. Cincinnati

Facts:  The appellants were found guilt under and Ohio statute that made it a criminal defense for three or more persons to assemble on any of the sidewalks and there conduct themselves in a manner annoying to persons passing by.

Procedure:  Convictions were upheld by the Ohio SC.

Issue:  Was the Ohio statute unconstitutional on its face?

Holding: Yes

Rationale:  The statue is unconstitutionally vague because it subjects the exercise of the right of assembly to an unascertainable standard.  The statute is unconstitutionally broad because it authorizes the punishment of constitutionally protected conduct.
