Draper
v. United States:
United States Supreme
Court, 1959.
Facts:
Known informant gave information that
Draper would be carrying heroin. Informant particularly
detailed Drapers physical appearance, the clothes, tan bag
he would carry, that he would be getting off a train Sept. 8 or
9, and that he would be walking fast.
The Cops arrested him, with him having the
most clear information, and found the Heroin.
Reasoning:
- Hearsay can be the
basis of a finding of probable cause.
- The test is that:
- The
information came from a past reliable informant,
and
- The
excellent accuracy of everything gave reasonable
grounds that the drug claim would be true
also.
- The Court found
that there was probable cause.
