Draper v. United States 
United States Supreme Court, 1959. 

Facts:

      Known informant gave information that Draper would be carrying heroin.  Informant particularly detailed Draper’s physical appearance, the clothes, tan bag he would carry, that he would be getting off a train Sept. 8 or 9, and that he would be walking fast.

      The Cops arrested him, with him having the most clear information, and found the Heroin.

Reasoning:

  • Hearsay can be the basis of a finding of probable cause.
  • The test is that:
    • The information came from a past reliable informant, and
    • The excellent accuracy of everything gave “reasonable grounds” that the drug claim would be true also.
  • The Court found that there was probable cause.
