Facts: Df used devise to trick the automatic box into dispensing a cigarette without paying for it.
Issue: Whether a person can commit larceny by trick in obtaining property with intent to deprive?

Procedure: Unclear, indicted for larceny. Verdict of guilt by judge.
Rule: Appropriating or Obtaining the property of another for purpose of permanently depriving him of that property is larceny.
Ct. Rationale: df did use a piece of metal, in the place of coin, to obtain and appropriate a cigarette from the machine, when that cigarette was the property of another until such time as payment was tendered for it.
