Krulewitch v. United States

Supreme Court of Unted States (1949)

Petitioner/Defendant: Krulewitch; the defendant and another woman induced the victim to travel to Miami from New York for prostitution. The defendant was the only one who was charged with three counts of conspiracy. The issue here involves the introduction of hearsay evidence to the trial in which the victim told the jury about her conversation with the defendant's coconspirator one month after her visit to Miami. The hearsay evidence clearly showed the guilt of the defendant. Now the defendant appeals and challenges the admission of this evidence.

Issue: Can this hearsay conversation, which took place one month after the alleged conspiracy, be introduced as evidence?

Holding: No

Legal Reasoning: The court ruled that the only hearsay evidence that can be introduced is the conversation which is used in furthering the conpiracy. The court reasoned that since the conversation in evidence took place one month after the success or failure of the conspiracy in question, it can not be introduced because it was not used in furtherance of the conspiracy. The conviction was reversed.
